By visiting our website, submitting a contact or estimate request, or entering into a service agreement with us, you acknowledge that you have read and agree to be bound by these Terms. If you do not agree, please do not use our website or engage our services.
These Terms apply to all visitors, prospective customers, and customers who use our website or hire us for concrete work.
Bedrock Rochester Concrete Works provides concrete contractor services in Rochester, Minnesota, and the surrounding region. Our services include but are not limited to: concrete driveway building, concrete patio construction, stamped concrete, concrete sidewalks, garage floor concrete, decorative concrete, retaining walls, concrete floor installation, pool decks, concrete steps, slab foundations, foundation installation, concrete parking lots, concrete footings, foundation raising, and concrete cutting.
The specific scope of work for any project is defined by the written estimate or contract we provide to you. We do not guarantee any particular outcome beyond what is described in that written agreement.
All estimates we provide are based on a site visit, your project description, and current material and labor costs at the time of the estimate. Estimates are valid for 30 days from the date of issue unless otherwise stated in writing.
An estimate is not a binding contract. Work begins only after you accept the written estimate or contract and any required deposit has been received. The final cost may differ from the estimate if unforeseen site conditions, changes in scope, or customer-requested modifications occur during the project. We will notify you of any material cost changes before proceeding.
Material prices are subject to market conditions and may change between the time of your estimate and the start of your project. If significant price changes occur, we will communicate them to you in writing before beginning work.
Project scheduling is subject to weather conditions, crew availability, and the constraints of the concrete pouring season in Minnesota (generally late spring through early fall). We will provide you with an estimated start date and will communicate any changes as soon as reasonably possible.
We reserve the right to delay or postpone work due to weather conditions that would negatively affect concrete quality, including temperatures near or below freezing, high winds, or heavy rain during a pour.
If you need to cancel a scheduled project, please notify us as soon as possible. Cancellations made fewer than 48 hours before a scheduled start date may result in a cancellation fee to cover mobilization costs already incurred. Any deposit paid toward materials that have already been ordered may be non-refundable. The specific terms will be outlined in your written contract.
Payment terms are outlined in the written estimate or contract for each project. Standard payment terms include a deposit at the time of contract signing, with the remaining balance due upon project completion. Specific percentages and amounts will be stated in your contract.
Accepted payment methods will be stated in your contract. Payment is due within the time frame specified in your contract. Accounts that are past due may be subject to a late fee. We reserve the right to pause or stop work on a project if payments are not made on schedule.
If a dispute arises regarding an invoice or payment, please contact us in writing at sales@rochesterconcreteworks.com so we can work toward a resolution promptly.
We stand behind the quality of our work. Any specific warranty we offer on a project will be stated in your written contract.
Concrete is a natural material that is subject to cracking, surface wear, and movement over time - particularly in Minnesota's freeze-thaw climate. Minor hairline cracking in concrete surfaces is normal and does not constitute a defect in workmanship. Our warranty, where applicable, covers defects in materials and workmanship that fall outside the normal behavior of concrete in this climate.

Except as expressly stated in your written contract, all services are provided "as is" and without additional warranties, express or implied, to the fullest extent permitted by law.
To the fullest extent permitted by applicable law, Bedrock Rochester Concrete Works shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of a project shall not exceed the total amount paid to us for that specific project. This limitation applies to all claims, whether based in contract, tort, negligence, or any other legal theory.
Some states do not allow the exclusion or limitation of certain damages. In those cases, our liability will be limited to the maximum extent permitted by law.

We are not responsible for damage to underground utilities or other features that were not disclosed to us prior to work beginning.
Where required, we will obtain the necessary permits for your project as part of our standard process. Permit fees, if any, may be included in your estimate or billed separately - this will be stated in your contract.
You are responsible for confirming that the project complies with any homeowners association rules or deed restrictions that apply to your property. We will build to local code requirements, but compliance with HOA rules is your responsibility.
The content on our website - including text, images, and other materials - is provided for informational purposes only. We make reasonable efforts to keep information accurate and current, but we do not guarantee that all content is complete, accurate, or up to date at all times.
You may not use our website for any unlawful purpose or in any way that could damage, disable, or impair the site. Unauthorized reproduction or distribution of website content is prohibited.

If informal resolution is not possible, disputes shall be resolved through binding arbitration in Rochester, Minnesota, in accordance with the rules of the American Arbitration Association, unless both parties agree otherwise in writing. Each party will bear its own costs in arbitration, except as awarded by the arbitrator.
You agree to waive any right to a class action lawsuit or class-wide arbitration against us.
These Terms and any disputes arising from our services or this website are governed by the laws of the State of Minnesota, without regard to its conflict of law provisions. Any legal action that is not subject to arbitration shall be brought in a court of competent jurisdiction in Olmsted County, Minnesota.
We may update these Terms from time to time. When we do, we will post the updated version on this page with a new effective date. We encourage you to review these Terms periodically. Your continued use of our website or engagement of our services after changes are posted constitutes your acceptance of the updated Terms.
Changes to these Terms do not affect the terms already in place under a signed project contract.
